Have you considered that water in John 3 is a reference to the word of God given what 1 Peter 1:23 says?
Since the reference to Spirit is literal there is no reason to assume the reference to water is not literal as well. And as mentioned, scripture confirms the NT conversion involves both literal water and Spirit. (Acts 2:2, 36-41, 8:12-18, 9:17-18, 10:43-48, 19:1-7, 22:16)

so it sounds like you believe that sins are only forgiven if you get baptized. is that what you are saying?
Sounds like you are looking for a loophole. Is that what you are saying?

forget it. everyone isn't able to get baptized. it's common sense that you don't have to get baptized to have sins forgiven & it's not Biblical. not conversing on this anymore. blessings to you.

Your what if scenarios and your personal sensibilities will never negate what is written.

Let the world be a liar but the Word of God be true.

Jesus said all will be judged by the word. (John 12:48) And man is without excuse because the purpose of water baptism is clearly outlined within its pages.

"And thou, child, (John the Baptist) shalt be called the prophet of the Highest: for thou shalt go before the face of the Lord to prepare his ways;
To give knowledge of salvation unto his people by the remission of their sins,
Through the tender mercy of our God; whereby the dayspring from on high hath visited us,
To give light to them that sit in darkness and in the shadow of death, to guide our feet into the way of peace."
