Actually James says it to believers, not the wicked. Just after he warns them that not many people should be teachers. Just before he tells us the difference between earthly demonic wisdom and heavenly wisdom.

I condem you not is not something we will always achieve... Where the saying Goes there is no condemnation in christ i condem you not... It does not me mean i wont condem anyone it means Jesus will not condem me.. but how ever he will convict me.. he will convict and punish me accordingly but he wont forever condem me..

Im just illussioned how youve even brought the subject of law into this argument,,What do Good works have to do with the law...See..you still miss the mark....the law CONDEMNS NO ONE WHO IS IN CHRIST....God's grace outbounds the SIN of all true believers....this is where your working for false gospel leads you astray....When Jesus said it is finished....that equals paid in full....every genuine believer's entire SIN DEBT HAS BEEN PAID IN FULL....THE BLOOD AND RIGHTEOUSNESS of CHRIST applied and imputed.....fail to believe this = no genuine faith into the completed work of CHRIST.....END OF STORY!
I agree that the law of love wins over condemnation but how ever that still doesnt take away what the law must accomplish in the believer.. meaning the law is holy in this way..It's a thin line between rebuking and convicting someone and condemning them.

Love...if you love the person and they know that you love them.
If you love someone you may be rebuking them to convict them,but if they don't know you love them,they will feel like you are condemning them.
