They refused to stop doing evil.

Look at how many times Isreal repented, and then turned away again while being lead out of Egypt in the wilderness. Before coming to the promised land.

yes that is truth about it. They breaking the commandments and also, would not repent. Jesus said he will never leave us, nor forsake us.

and yes, it was the old covenant, we are under the new covenant, with Jesus Christ.

Something to make note of, is God is not like a human judge, in that he has to do everything by the book. God is not bound by law.

The new covenant is that we are no longer under the law. And the we are children of God. And free from sin. The devil no longer has the keys to heaven and hell, Jesus has them. If your works are not of God, then you will be judged. According to our works we will be judged. You get saved, don't mean you can do the works of the devil. It means your sins are forgiven. Our sins are forgiven, yesterday, today and tomorrow. But you have to repent and do good works. Death is cast into hell.
