Act 2:39, For the promise is unto you, and to your children, and to all that are afar off, even as many as the Lord our God shall call.
Rom 8:30, Moreover whom he did predestinate, them he also called: and whom he called, them he also justified: and whom he justified, them he also glorified.
Obviously, the conditional promise of Acts 2:38 is only given to those who are called. If you are never called, then you are not predestinated, and have not been and will not be justified.

The condition being repentance and baptism in the name of Jesus Christ of Nazareth for the remission of sins.

Water baptism is mentioned as the moment in time for the remission of sins to those who confess Jesus as Lord.
Must we confess Jesus as Lord? Of course.
and
Must we believe in our heart that God raised Him from the dead? Of course.
but to use these "must"s as the moment in time for the remission of sins is bogus.
The moment in time of the remission of sins is water baptism.
To take Romans 10:9 and label it as definitive and all-encompassing is poor logic.
I accept Romans 10:9 for what it is, a general statement of truth but it is clearly not written in the definitive.
It can not be used to debase the clear meaning of another verse. If Paul wanted this verse to be inclusive he could have simply worded it as such.
Romans 10:9 can not be used to change the meaning of Acts 2:38 nor can Acts 2:38 be used to disprove the meaning of Romans 10:9.
Neither are written in the definitive.
Neither is all-encompassing.
Neither contradict the other.
