I've always said that there were pros and cons to mandatory minimum sentencing, this case does magnify the cons.

Per the statute that that the driver was charged with numerous counts of, the sentence given was the minimum allowable.

Both the District Attorney and the defense attorney are filing petitions to reconsider the sentence.

I don't know anything about these kinds of trucks but I've been following the story on Facebook.
Apparently this is a common problem when driving downhill in the mountains. The brakes overheat and fail
I hear from experienced truck drivers that they know how to compensate for this by downshifting and engine braking
Prosecution argued that he was negligent because he drove past at least one emergency truck ramp and also could have turned over onto the grass medium

It appears that the driver was not experienced enough for the terrain and road conditions. He should not have received a prison sentence, but possibly a suspension of his CDL and a fine.
