I wouldn't doubt that such a plan existed long before 2007. Realistically, we have to have something like this in place, though- like if somebody's spouse contracts the black plague (7 cases per year in the US) we don't want them running around spreading it like an idiot, whether they are symptomatic or not. There's always been a risk of people in government exploiting some power of their office; but separation of powers makes us pretty resistant against that on a national level.
